These terms govern use of Cerebro Coach (the "service"), operated by Muscle Nerds ("MN", "we", "us"). By signing in as a Coach, or by opening a Client link and verifying your email, you agree to them. If you do not agree, do not use the service.
1. What the service is
Cerebro Coach helps fitness coaches gather an intake from their clients, recommends training methods from MN's methodology and lets coaches build, edit and export training programs. It is a tool for professionals. It is not medical advice and it does not replace a coach's judgement.
2. Accounts and access
Coach accounts are created by invitation from MN. You must give accurate details, keep your password private and tell us if you think your account has been compromised. You are responsible for everything done under your account.
Access is granted at MN's discretion, typically alongside an MN membership or program. MN may suspend or close an account at any time, including if these terms are broken, if the related membership lapses or if the service is discontinued. We will give reasonable notice where we can.
Clients access the service through a private link sent by their Coach. Do not share your link. Your Coach can revoke it and issue a new one at any time.
3. Acceptable use
You must not:
- enter data about someone without a lawful basis to do so, or about anyone under 18 without a parent's or guardian's consent;
- use another person's account or link, or try to access data that is not yours;
- copy, resell or redistribute MN's methods, recommendation logic, exercise library or content outside of programs for your own clients;
- upload anything unlawful, defamatory or infringing;
- interfere with the service, probe its security or load it beyond normal use.
4. Your content and MN's content
You own the intake data and program edits you enter. You give MN a licence to store and process them to run the service, and to use them in aggregated, de-identified form to improve the product. MN owns the service, its methodology, the recommendation engine, the exercise library and all program templates and text it provides. You may use exported programs with your own clients as part of your coaching.
5. Health and safety
Programs produced by the service are suggestions based on the information entered. The Coach is responsible for reviewing every program, for the suitability of exercises for a particular client, and for advising clients to seek medical clearance where appropriate. Clients should stop training and seek medical advice if they feel unwell. MN does not supervise training and is not responsible for injury.
6. Privacy
Our privacy policy explains how we handle personal data. Coaches are responsible for having a lawful basis to enter their clients' data and for meeting their own privacy obligations to those clients.
7. Availability and changes
The service is provided as is. We aim for it to be available and accurate but do not guarantee either, and we may change, pause or withdraw features at any time. Back up anything you cannot afford to lose by exporting it.
8. Liability
To the extent the law allows, MN excludes all warranties not set out here and is not liable for indirect or consequential loss, lost profits or lost data arising from the service. Where liability cannot be excluded, it is limited to re-supplying the service or the amount you paid MN for it in the previous 12 months, whichever is greater. Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded.
9. Ending these terms
You can stop using the service at any time and ask us to close your account by emailing privacy@cerebro.coach. Sections 4, 5 and 8 survive termination.
10. General
These terms are governed by the laws of Queensland, Australia, and disputes go to the courts there, unless the law where you live gives you the right to bring a claim locally. If part of these terms is unenforceable the rest still applies. We may update these terms; we will change the date above and notify Coaches by email of significant changes. Continued use after that is acceptance.
